Welcome to BlueBirdHost ("we", "our", "us"). These Terms of Service govern your use of our Minecraft server hosting services. By purchasing, accessing, or using our services, you ("User," "Customer," or "you") agree to be bound by these Terms. If you do not agree to these terms in full, you must immediately cease using our services and close your account.
1. Services Provided
BlueBirdHost provides Minecraft server hosting and related infrastructure services. This includes, but is not limited to, virtual server instances, control panel access, technical support, and related management tools. We reserve the right to modify, expand, or discontinue any aspect of our services at any time without prior notice.
2. Eligibility
You must be at least 13 years of age to use our services. If you are under 18, you must have the consent of a parent or legal guardian who agrees to these Terms on your behalf.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- All information provided to BlueBirdHost must be accurate, current, and complete.
- You must promptly notify us of any unauthorized use of your account.
BlueBirdHost will not be held liable for any loss or damage arising from your failure to comply with these obligations.
4. Acceptable Use Policy
You may not use BlueBirdHost to host or operate:
- Proxy & Network Abuse: Your server may not be used as a proxy, VPN, Tor exit node, traffic relay, or any similar service. Resources are strictly for legitimate Minecraft server operation.
- Resale of Services: You may not sublet, resell, or transfer your hosting resources to third parties without our express written consent.
- Illegal Activity: Any activity that violates applicable local, national, or international laws or regulations.
- Malicious Software: Malware, ransomware, DDoS tools, exploit kits, botnets, or any other harmful software.
- Network Attacks: Denial-of-service (DDoS) attacks, port scanning, or unauthorized access attempts against any system.
- Spam & Phishing: Unsolicited communications, phishing campaigns, or fraudulent content.
- IP Violations: Content that infringes on the intellectual property rights of any third party, including Mojang Studios / Microsoft.
Violation of this policy may result in immediate suspension or termination of your account without refund.
5. Server Content
BlueBirdHost acts solely as a hosting provider. We are not responsible for any content created, stored, transmitted, or made accessible through servers hosted on our platform. This includes player data, world data, plugins, modifications, chat logs, and any material uploaded or generated by you or your players.
You are solely responsible for ensuring all content on your server complies with applicable laws and these Terms.
6. Server Suspension & Termination
BlueBirdHost reserves the absolute right to suspend, shut down, or terminate any server or account at any time, with or without prior notice, at our sole discretion. Reasons may include, but are not limited to:
- Violation of these Terms of Service or Acceptable Use Policy.
- Non-payment or failed billing.
- Abuse of server resources affecting other customers.
- Legal obligations or law enforcement requests.
- Security threats to our infrastructure.
- Business or operational decisions.
We will make reasonable efforts to notify you in advance when feasible, but we are under no obligation to do so.
7. Downtime & Availability
BlueBirdHost does not guarantee uninterrupted service availability. Downtime may occur due to maintenance, hardware failure, network issues, or circumstances beyond our control. No refunds, credits, or compensation of any kind will be issued for service downtime, regardless of cause, duration, or frequency.
8. Technical Support
Technical support is provided as a courtesy. While our team will make reasonable efforts to assist you, we cannot guarantee that any issue will be resolved. Support is limited to our hosting infrastructure and does not cover third-party software, custom plugins, or Minecraft gameplay issues.
9. Payment & Billing
- All fees are due in accordance with the billing cycle selected at purchase.
- Failure to pay on time may result in suspension or termination without notice.
- All sales are final. Refunds are only issued where required by applicable consumer protection law.
- No refunds will be issued for downtime, service interruptions, or terminations due to Terms violations.
- Prices are subject to change. We will make reasonable efforts to notify you in advance.
10. Limitation of Liability
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLUEBIRDHOST AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THIRTY (30) DAYS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless BlueBirdHost and its owners, employees, and partners from any claims, liabilities, damages, or expenses arising from your use of our services, your violation of these Terms, or any content hosted on your server.
12. Data & Privacy
We collect and process personal data in accordance with our Privacy Policy. We do not sell your personal information to third parties. We may disclose information when required by law or to protect the rights, safety, or property of BlueBirdHost or others.
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Hamburg, Germany. EU consumers may also bring proceedings before the courts of their country of residence. For disputes, please first contact us at info@bluebirdhost.de.
14. Miscellaneous
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and BlueBirdHost.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
- No Waiver: Failure to enforce any provision does not waive our right to enforce it in the future.
- Assignment: You may not transfer your rights under these Terms without our prior written consent.
